The Commission, in its sole and absolute discretion, may change or modify this Policy, and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to the Website. No revision or update will apply to a dispute which the Commission had actual notice of on the date the Commission posts the changes or modifications. The Commission will notify you of such changes or modifications by posting them to the Website, and your use of the Website after such changes or modifications have been posted (as indicated by a 'Last Revised' date) shall constitute your acceptance of the Policy as last revised. If you do not agree to with the Policy as last revised, do not use (or continue to use) the Website.

Information Collected

Types of Information

When you visit the Website or become a User of the Website, we may ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you ('Personal Information'). Personal Information includes, but is not limited to, your name, username, phone number, email address, and shipping address. Methods of Collection

Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Website Users (defined below) to attempt to provide you with a better experience, to improve the quality and value of the Website and to analyze and understand how our Website is used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.

We may also use your Personal Information to contact you with Commission newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, follow the unsubscribe instructions provided in any of the communications or update your 'preferences' information.

We may use Log Data to monitor and analyze use of the Website and for the Website's technical administration, to increase the Website's functionality and user-friendliness, and to better tailor our Website to our visitors' needs. For example, some of this information may be collected so that when you visit the Website again, it may recognize you and serve advertisements and other information appropriate to your interests. We also reserve the right to use this information to verify that visitors to the Website meet the criteria required to process their requests. Please be advised that all information which is collected by state agencies is likely to be considered a public record which is available for public review under the Nebraska Public Records Statutes unless there is a specific statute which allows that information to be kept confidential. The Website is maintained by a private company, Bailey Lauerman & Associates Inc., under contract with and management of the Nebraska Tourism Commission. Data gathered through the Website, or through portals or data interchanges maintained by the Commission and submitted to state agencies are government records subject to the same rules of access and disclosure as they would be if submitted in paper form. As stated elsewhere in this notice, the general rule under Nebraska public records law is that all government records are open to public inspection unless expressly exempt from that requirement by law.

We may employ third party companies and individuals to facilitate our Website, to provide the Website on our behalf, to perform Website-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Website's features) to assist us in analyzing how our Website is used, or to perform other services (e.g. without limitation, sending postal mail and e-mail and providing customer service). These third parties have access to your Personal Information only to perform these tasks on our behalf.

The Commission may cooperate with other government and law enforcement officials and private parties to enforce and comply with applicable law. We may disclose any information about you to government or law enforcement officials or private parties as we believe necessary or appropriate to respond to claims and legal process (including, but not limited to, subpoenas), to protect the property and rights of the Commission or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.

Security

The Commission takes reasonable precautions to keep your personal information secure and has put in place appropriate physical, electronic, and managerial procedures to safeguard the information collected through the Website. Due to the nature of the Internet, however, the Commission cannot guarantee the security of any information you disclose online, and you do so at your own risk.

We may make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored 'personal data' (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Website in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Choice and Control

All Users may review, update, correct or delete the Personal Information in their Account by contacting us or by editing such profile via the Website, or other authorized third party account. If you completely delete all such information, then your Account may become deactivated. We will use commercially reasonable efforts to honor your request. Children's Privacy

As a whole, the Website is not directed to children under the age of 13. We do not knowingly collect personally identifiable information from children under 13. Federal law provides that the Commission may not require a child to disclose more information on the Website than is reasonably necessary to participate in an activity as a condition of that participation. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us using the information below ('How to Contact the Commission'). If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
